By accessing and using TradeStory ("the Platform", "Service", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our Platform.

These Terms of Service apply to all users of the Platform, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

We reserve the right to modify these terms at any time. Your continued use of the Platform following any changes indicates your acceptance of the new terms.

TradeStory is a free online platform that facilitates bartering and trading of goods and services between individuals. We provide the technology and infrastructure to connect traders but are not party to any transactions between users.

The Platform allows users to: create profiles, list items for trade, browse available items, communicate with other users, arrange meetings, and rate trading experiences.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

You must be at least 18 years old to use TradeStory. By using the Platform, you represent and warrant that you are at least 18 years of age.

Users under 18 may use the Service only with involvement and supervision of a parent or legal guardian who agrees to be bound by these Terms.

You must provide accurate and complete registration information and keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Users agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:

• Post or trade prohibited items including weapons, illegal substances, stolen goods, counterfeit items, or hazardous materials

• Engage in fraudulent, deceptive, or misleading practices

• Harass, abuse, threaten, or intimidate other users

• Impersonate any person or entity or misrepresent your affiliation with any person or entity

• Violate any local, state, national, or international law

• Post content that is defamatory, obscene, offensive, or infringes on intellectual property rights

• Attempt to gain unauthorized access to any portion of the Platform or any other systems or networks

• Use automated systems or software to extract data from the Platform (scraping)

You are solely responsible for the accuracy of your listings, the quality and condition of items you trade, and for all communications with other users.

TradeStory is a platform that facilitates connections between users. We are not a party to any agreements between users and have no control over the quality, safety, legality, or availability of items listed.

All transactions are conducted entirely between users. We do not guarantee the quality, safety, or legality of any items or the truth or accuracy of listings.

Users are solely responsible for determining the suitability of potential trading partners and the terms of any trades. We recommend:

• Meeting in public safe spots

• Thoroughly inspecting items before completing trades

• Trusting your instincts and reporting suspicious behavior

• Never sharing financial information or payment credentials

We strongly encourage users to communicate through the Platform to maintain a record of interactions.

Users may post content including listings, messages, photos, reviews, and comments. You retain ownership of content you post but grant TradeStory a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, publish, and display such content.

You represent and warrant that you own or have the necessary rights to post your content and that your content does not violate any third-party rights.

We reserve the right to remove any content that violates these Terms or that we deem inappropriate, offensive, or harmful without prior notice.

We do not guarantee the accuracy, quality, or reliability of any user-generated content and are not responsible for any content posted by users.

The Platform and its original content, features, and functionality are owned by TradeStory and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks, logos, and service marks displayed on the Platform are our property or the property of third parties. You may not use these without prior written consent.

You may not copy, modify, distribute, sell, or lease any part of our Platform or included software without our express written permission.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

We collect, use, and protect your personal information as described in our Privacy Policy.

By using the Platform, you consent to the collection and use of information as outlined in our Privacy Policy.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADESTORY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

We do not guarantee the Platform will be uninterrupted, timely, secure, or error-free. We are not responsible for:

• Any trades or transactions between users

• The conduct of any user

• Any content posted by users

• Any loss or damage resulting from use of the Platform

You assume all risks associated with trading items through the Platform.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless TradeStory, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

• Your use of the Platform

• Your violation of these Terms

• Your violation of any rights of another party

• Your conduct in connection with the Platform or any trades

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice, for conduct that we believe:

• Violates these Terms

• Is harmful to other users, us, or third parties

• Violates applicable laws or regulations

Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

You may terminate your account at any time by contacting us or using account deletion features in your settings.

Any disputes arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree to first contact us to seek informal resolution of any disputes before initiating arbitration.

The arbitration will be conducted in English and the arbitrator's decision will be final and binding.

You agree to waive your right to participate in a class action lawsuit or class-wide arbitration.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

We reserve the right to modify or replace these Terms at any time at our sole discretion.

We will provide notice of any material changes by posting the new Terms on the Platform and updating the "Last Updated" date.

Your continued use of the Platform following any changes constitutes acceptance of those changes.

It is your responsibility to review these Terms periodically for updates.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

The invalid or unenforceable provision will be deemed modified to the extent necessary to make it valid and enforceable.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TradeStory regarding your use of the Platform.

These Terms supersede any prior agreements or understandings, whether written or oral.
